These Terms of Service are between you and Tringify Ecommerce Private Limited, an Indian company operating the Tringify platform. They govern your access to our products and services. Specific store, developer and partner agreements apply to the corresponding services; a specific agreement prevails for its subject matter where it expressly differs from these Terms.
1. Acceptance of Terms
By accessing or using Tringify's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
We may update these Terms as our services or legal requirements change. We will communicate material changes and their effective date through the applicable account or notice channels. Changes required urgently for security or law may take effect sooner. Changes do not remove rights that accrued before they took effect.
2. Account Registration
To use certain features of our services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. Use of Services
You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services in any way that violates applicable laws or regulations, or to engage in any conduct that restricts or inhibits anyone's use of the platform.
You must not attempt to gain unauthorized access to any part of our services, other accounts, computer systems, or networks connected to our servers. You may use documented APIs and supported automation within their permissions, limits and published terms. You must not bypass access controls, scrape information you are not authorised to access, or interfere with the services.
4. Intellectual Property
Tringify and its licensors retain their rights in the platform, software, documentation, branding and other materials. Those rights are protected under applicable intellectual-property law. Use of the service does not transfer ownership of those materials to you.
You retain ownership of any content you submit, post, or display on or through our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with providing and improving our services.
5. Payment Terms
Certain services require payment of fees. You agree to pay all fees associated with your chosen plan. Fees are non-refundable except as expressly stated in our refund policy or as required by applicable law.
We may change our fees at any time. If we change fees for a service you are currently subscribed to, we will provide you with advance notice. Your continued use of the service after a fee change constitutes your agreement to pay the new fees.
All payments are processed through secure third-party payment processors. We do not store your full payment card details on our servers.
6. Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service.
When access ends, the applicable closure flow and agreement explain any remaining access or export opportunity. Export business information you need before closing a store or account. Privacy rights and retention obligations remain separate; use privacy.tringify.com for a personal-information request. We may retain records needed for law, billing, security or disputes, as explained in the Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by law, Tringify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
In no event shall our aggregate liability exceed the greater of one hundred dollars ($100) or the amount you paid us in the twelve (12) months preceding the claim.
8. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis. Tringify makes no warranties, expressed or implied, regarding the operation of our services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We work toward a 99.9% monthly availability objective for core production commerce services, as described on our service-levels page. This is an operating target, not a historical uptime statement or automatic credit entitlement. A contractual SLA applies only when expressly agreed in writing and defines its own coverage and remedies.
9. Governing Law
These Terms are governed by the laws of India, subject to mandatory protections that apply to you and cannot be excluded by contract.
Contact legal@tringify.com to seek an informal resolution before bringing a claim, where lawful and practicable. Courts with jurisdiction at Tringify's registered office in India will hear disputes, except where mandatory law gives you another forum. Nothing restricts a complaint to a regulator or urgent relief that the law permits.
